The Commissioners of Rehoboth Beach Virtual Special Meeting will be held on Thursday, October 29, 2020, at 10 a.m.

PLEASE NOTE - AS PERMITTED BY GUBERNATORIAL AUTHORITY, IN ORDER TO LIMIT THE RISK OF POTENTIAL COVID-19 EXPOSURE, THE PUBLIC SHALL BE DENIED ENTRY TO THE BOARD OF COMMISSIONERS SPECIAL MEETING.(1)  THE PUBLIC IS ENCOURAGED TO PARTICIPATE IN THE BOARD OF COMMISSIONERS SPECIAL MEETING ELECTRONICALLY.  FURTHER INSTRUCTIONS ARE LISTED AT THE BOTTOM OF THIS AGENDA.

3. The purpose of this Special Meeting is to:

A. Consider and decide several preliminary motions and motions to dismiss regarding the appeals of site plan approvals for Site Plan Review Application No. 0620-03 - Clear Space Theatre and Site Plan Review Application No. 0620-03 - Rehoboth Spotlight.

As the matters to be heard relate to appeals filed pursuant to §236-6 of the Municipal Code, which only allows persons who provided written or oral testimony before the Planning Commission the ability to appeal and restate their position (and because evidence and legal arguments not on the record of the hearing before the Planning Commission may not be presented), no public comment will be allowed.

**The Board of Commissioners is holding this meeting under the authority issued by Governor John C. Carney through Proclamation No. 17-3292.(1)  The meeting will be conducted using video-conference technology.

The City will stream this meeting using the same technology it uses during its chamber broadcast that can be viewed on the City portal at /Portal/ or YouTube.  This stream will broadcast the meeting, the public will not be able to comment or speak using this broadcast.  This stream will experience a 30-second delay.

The Board of Commissioners meeting materials, including the "packet", are electronically accessible on the City's portal at /Portal/.

(1) These restrictions are being implemented to limit the exposure and risk related to "COVID-19" for City personnel and members of the public who seek to attend the Board of Commissioners meeting.  These decisions are being made under the authority issued by Governor John C. Carney through Proclamation No. 17-3292.
